GENERAL TERMS AND CONDITIONS

These contractual provisions govern the relationship between the customer and ThermalBaden AG (hereinafter referred to as FORTYSEVEN), including with regard to the sale of tickets and reservations on the website fortyseven.ch and at the ticket counter. These also apply to the sale of season tickets. 

Persons who contact FORTYSEVEN, visit the FORTYSEVEN wellness thermal spa or access the FORTYSEVEN website agree to the following Terms of Use as amended: 

1. Knowledge of the use of electronic means of communication

Users of the FORTYSEVEN website confirm that they are familiar with electronic means of communication and are aware of the security risks associated with electronic traffic. Users undertake to only make lawful use of the means of communication. 

2. Establishment of the contractual relationship 

The customer may purchase vouchers and tickets in the online shop and book a reservation exclusively online. FORTYSEVEN sends an electronic confirmation of the order to the customer. 

The contractual relationship comes into effect when the electronic confirmation is sent to the customer. From that moment on, the customer cannot change or cancel the order online. 

3. Online ticket purchase  

By purchasing tickets, the purchasers of online tickets at fortyseven.ch acknowledge the security, access and other regulations (e.g. house rules) of FORTYSEVEN. Online tickets may only be purchased from the official website or from authorised partners of FORTYSEVEN. The purchasers of tickets also acknowledge that they may be excluded by FORTYSEVEN without compensation in the event of non-compliance with such regulations. 

3.1 Personal Ticket

Online tickets are transferable, with the exception of personal season tickets (e.g. monthly or annual season tickets). Tickets must be protected from moisture and may not be altered or copied. The validity of the ticket is checked electronically by FORTYSEVEN (using a barcode). 

3.2 Damaged tickets 

Tickets whose microstructure or barcode is damaged in any way lose their validity, but can be printed again from the personal account. In the event of duplicates or fraudulent activities (resulting in reporting to the authorities), FORTYSEVEN reserves the right to reject all tickets and refund the price to the rightful holders. 

3.3 Validity of online tickets 

Online tickets are only valid for the specified day and the services listed. Changes to bookings or refunds are not possible.   

4. Gift Vouchers  

4.1 Ordering vouchers 

When ordering a voucher, the voucher can be obtained online as a PDF document and printed out locally by the customer (Print@Home). The customer is responsible for ensuring that the necessary prerequisites for printing the voucher are met. The customer shall take the necessary precautions to prevent unauthorised use or misuse (e.g. copying, alteration or printing out by unauthorised persons). Purchased vouchers may not be shared on the Internet or other networks or used for commercial purposes. Printed vouchers must be stored in such a way that all details on the voucher, in particular the voucher number and barcode, remain clearly legible. FORTYSEVEN accepts no liability for damages incurred by the customer due to use or misuse by unauthorised persons or due to illegible vouchers. 

4.2 Voucher validity period 

The gift vouchers can be redeemed in the entire FORTYSEVEN wellness thermal spa (thermal bath, gastronomy, shop, spa treatments). Designated vouchers with a corresponding imprint are exempt from the above. A balance query can be made at any time. The vouchers are valid for 10 years from the date of purchase. If the vouchers are not redeemed before the expiry date, the credit is forfeited. No cash payments are possible. The voucher will not be replaced in the event of loss or theft.  

5. Reimbursement  

Vouchers cannot be returned to FORTYSEVEN. Products in impeccable, saleable and unopened condition from the FORTYSEVEN shop can be returned within 10 days (date of invoice) for credit. The receipt must be presented. In the event of product manufacturing defects, the products in question shall be exchanged for impeccable ones, provided that the customer has inspected and returned the products concerned within 10 days of receipt.  

6. Cancellation policy 

6.1 Cancellations for treatments, courses and workshops at the spa 

Cancellations for booked treatments, courses and workshops at the spa must arrive at FORTYSEVEN at least 24 hours before the booked date. If cancelled in good time, a voucher will be issued. If a cancellation is received less than 24 hours before the booked date, FORTYSEVEN reserves the right to issue an invoice for the booked service. 

Instead of a cancellation, the booked services may be used by a substitute person designated by the customer. 

Cancellations must be made by sending an e-mail to spa@fortyseven.ch. 

6.2 Changes and cancellations for reserved entries or catering services  

Changes to the number of persons or cancellations during the high season (December/January) for reserved entries or catering services for 12 or more persons must be received by FORTYSEVEN up to 48 hours before the booked date. 25% of the default amount will be invoiced if the cancellation is received up to 24 hours before the booked date. If a cancellation is received less than 24 hours before the booked date, FORTYSEVEN reserves the right to issue an invoice for the entire service. 

Cancellations must be made by sending an e-mail to gastronomie@fortyseven.ch. 

11. Limited offer

In the event of limited use of the FORTYSEVEN wellness thermal spa, the purchaser of the ticket has no right to return or exchange the ticket; such action is fundamentally excluded. Otherwise, ticket sales and season tickets may be stopped at any time without further justification. In the event of limited use of the FORTYSEVEN wellness thermal spa, season ticket holders are subject to the terms and conditions of the annual season ticket.  

12. Copyright protection

The entire content of the FORTYSEVEN website is protected by copyright; therefore, downloading or printing of individual pages and/or parts of the FORTYSEVEN website is only permitted if the copyright notices and other protected designations are not removed. In the event of downloading or reproduction in any other way, FORTYSEVEN retains all rights to the information. Commercial use of the FORTYSEVEN website or parts thereof is strictly prohibited.  

13. Data privacy 

The Privacy Policy of the website www.fortyseven.ch/datenschutzerklaerung applies. 

14. Disclaimer 

a) Tickets

FORTYSEVEN does not guarantee the accuracy of the information available on the website, in particular the correctness, completeness and reliability of the information in question. FORTYSEVEN accepts no liability for damage caused by transmission errors, technical defects, operational failures or unlawful interventions in IT systems, regardless of the location and type of impairment. Furthermore, FORTYSEVEN shall not be liable for damage resulting from faults, interruptions (including system-related maintenance work) or overloading of IT systems. FORTYSEVEN shall not be liable for direct or indirect damages (consequential damages) arising in connection with the use of services or queries from FORTYSEVEN. This disclaimer also applies to damages caused by links to other websites. FORTYSEVEN points out in particular that clicking on links may result in you leaving the website of FORTYSEVEN and that FORTYSEVEN has neither reviewed the linked sites nor accepts any responsibility for their content, products, services or other offers. The information disseminated on the FORTYSEVEN website is intended solely for private use and is provided to potential users of the system for information purposes only. Users are aware that the information may be changed at any time and without prior notice. 

b) Liability regarding use of the wellness facility

FORTYSEVEN accepts no liability for damage to property, personal injury or financial losses in connection with the FORTYSEVEN establishment. Use of the wellness thermal spa is at your own risk. In particular, FORTYSEVEN shall not be liable for: 

• Damage arising from the use of swimming pools, saunas or other thermal spa facilities; 
• Indirect damage caused by third parties (theft, damage to property, injuries resulting from the use of the thermal spa, etc.); 
• Loss of property, money or other valuables.

This disclaimer shall not apply if FORTYSEVEN or its personnel can be proven to have acted with intent or gross negligence.

c) Liability regarding participation in courses and workshops 

FORTYSEVEN accepts no liability whatsoever in the event of concealment of any physical or mental suffering that make it advisable for the person affected not to participate in courses and workshops. Furthermore, no liability claims may be brought against FORTYSEVEN and the participant that may arise from any health or medical problems as a result of the course. The customer is therefore personally responsible for ensuring adequate insurance cover. FORTYSEVEN reserves the right to reject participants if the course instructor is of the opinion that the health or mental prerequisites for participation in the course are not met. This rejection may also be carried out at short notice or during courses in progress. If the participant is rejected, the course fee will be refunded to the participant.

15. Amendments/additions  

Amendments and additions to these GTC by FORTYSEVEN are permitted at any time. The version published online at the time of the electronic confirmation by FORTYSEVEN shall apply. 

16. Law and place of jurisdiction  

This contractual relationship is governed by Swiss law. The place of jurisdiction is Baden (Canton of Aargau).
